1. Who we are
Hiera ("Hiera", "we", "us", "our") is an AI-assisted interior design workspace available at hiera.design. The service is operated by Hiera, Inc., a Delaware corporation with its registered address at 1111B S Governors Ave, STE 48131, Dover, DE 19904, United States ("the Company"). These Terms of Service ("Terms") govern your access to and use of Hiera, including our website, applications, collaboration features and AI-powered tools (together, the "Service").
By creating an account or using the Service you agree to these Terms and to ourPrivacy Policy. If you do not agree, do not use the Service.
2. Eligibility and accounts
You must be at least 16 years old to use Hiera. If you use Hiera on behalf of a company or client, you confirm that you are authorized to bind that organization to these Terms.
You can sign in with your email address or a Google account. You are responsible for keeping access to your email account secure, since sign-in links sent to your email grant access to your Hiera account. Notify us promptly at[email protected] if you suspect unauthorized use of your account.
3. The Service and AI credits
Hiera's core workspace is free to use. Certain AI features (such as image generation and AI-assisted editing) consume prepaid AI credits, which you can purchase inside the app. Payments are processed by Stripe; we do not store your card details.
- Credits are a prepaid usage allowance. They have no cash value, are not transferable outside your workspace, and cannot be exchanged for money.
- Credits do not expire unless we clearly state otherwise at the time of purchase.
- Prices for credits may change; changes never affect credits you have already purchased.
- By purchasing credits you request immediate delivery of digital content and, where permitted by law, acknowledge that you lose any statutory right of withdrawal once credits are delivered. Unused credits are otherwise refundable where required by applicable consumer law.
If an AI generation fails due to an error on our side, the consumed credits are returned to your balance.
4. Your content
"Content" means anything you upload or create in Hiera — images, drawings, PDFs, notes, comments, prompts and project data. You retain all rights you hold in your Content. You grant us a worldwide, non-exclusive license to host, store, reproduce, display and process your Content solely to operate, provide and improve the Service (for example, storing files, rendering canvases, syncing changes to collaborators and generating previews). This license ends when you delete the Content or your account, except for copies in routine backups, which are deleted on their normal schedule.
You are responsible for your Content. You confirm you have the necessary rights to upload it and that it does not infringe anyone's intellectual property, privacy or other rights.
We do not use your Content to train our own machine-learning models.
5. AI features and outputs
Hiera's AI features send your prompts and selected images to third-party AI model providers (currently OpenAI, accessed through an AI gateway) to generate results ("Outputs"). These providers process your inputs to deliver the feature and are contractually restricted from using API content to train their models.
- To the extent we hold any rights in Outputs, we assign them to you. You may use Outputs for any lawful purpose, including commercial work.
- AI can make mistakes. Outputs are not verified by us, do not represent our views, may be inaccurate, may not reflect real-world materials, measurements or building constraints, and are not professional architectural or engineering advice.
- You are responsible for evaluating Outputs before relying on them, including human review and obtaining any clearances needed for your intended use (for example, before presenting them to a client or using them in construction decisions).
- Similar prompts can produce similar Outputs for other users; we cannot guarantee uniqueness.
- You may not use AI features to create unlawful, infringing or deceptive content, or content that violates the rights of others.
6. Sharing and collaboration
Hiera lets you invite collaborators to workspaces and projects and create public links to files. Anyone with a public link can view the shared file without an account — share links carefully. Collaborators you invite can see and, depending on their role, edit the Content in the shared project. You are responsible for who you grant access to.
7. Acceptable use
You agree not to:
- use the Service for anything unlawful, or upload content that is illegal, infringing, hateful or sexually exploitative;
- probe, disable, overload or interfere with the Service or its security;
- access the Service by automated means (scraping, bots) except through interfaces we provide;
- resell or provide the Service to third parties as your own offering without our written consent;
- misrepresent AI Outputs as photographs of real, existing spaces where that would mislead or harm others.
8. Copyright complaints
If you believe content on Hiera infringes your copyright, email[email protected] with a description of the work, the location (URL) of the allegedly infringing material, your contact details and a statement that you believe in good faith the use is unauthorized. We will review and, where appropriate, remove the material and may terminate repeat infringers' accounts.
9. Our intellectual property
The Service itself — including software, design, logos and the Hiera name — is owned by the Company or its licensors and is protected by intellectual property laws. These Terms do not grant you any rights in the Service other than the right to use it as described here. If you send us feedback or suggestions, we may use them without obligation to you.
10. Termination
You may stop using Hiera and delete your account at any time. We may suspend or terminate your access if you materially breach these Terms, if required by law, or if we discontinue the Service (in which case we will give reasonable advance notice and an opportunity to export your Content where feasible). Upon termination for your breach, remaining credits are forfeited to the extent permitted by law.
11. Disclaimers and liability
The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement, and we do not warrant that the Service will be uninterrupted or error-free.
To the maximum extent permitted by law, the Company will not be liable for indirect, incidental, special or consequential damages, or for loss of profits, data or goodwill. Our total liability for all claims relating to the Service is limited to the greater of (a) the amount you paid us in the 12 months before the claim and (b) USD 50. Nothing in these Terms limits liability that cannot be limited by law, including liability for intent or gross negligence.
12. Changes to the Service and these Terms
We are actively developing Hiera and may change or discontinue features. We may update these Terms from time to time; if a change is material, we will notify you (for example by email or an in-app notice) before it takes effect. Continuing to use the Service after a change takes effect means you accept the updated Terms.
13. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law rules. Disputes will be resolved by the state and federal courts located in Delaware, unless mandatory consumer protection law gives you the right to bring or defend proceedings in your country of residence.
14. Miscellaneous
- Entire agreement — these Terms and the documents they reference are the entire agreement between you and the Company about the Service.
- Severability — if a provision of these Terms is found unenforceable, the rest remains in effect.
- No waiver — not enforcing a provision is not a waiver of our right to enforce it later.
- Assignment — you may not transfer your rights under these Terms without our consent; we may assign them as part of a merger, acquisition or sale of assets.
- Force majeure — neither party is liable for delays caused by events beyond its reasonable control.
